About Freedom of Information (Levern Property Services)
The Freedom of Information (Scotland) Act 2002 (the Act) requires Housing Association’s and subsidiaries (from 11 November 2019) to adopt and maintain a Guide to Information which complies with the Scottish Information Commissioner’s Model Publication Scheme, and publish information in accordance with that scheme.
In addition to this duty to publish, organisations must respond to legitimate requests for information they receive, and help people who want to access information covered by the Act.
Alongside the Act, the Environmental Information (Scotland) Regulations 2004 (the EIRs) provide a separate right of access to the environmental information that we hold.
Scope of FOI – LPS
Levern Property Services is only subject to the Act to the extent that it carries out services, on behalf of Barrhead Housing Association, in relation to the management of social housing accommodation.
Services which LPS therefore carries out on behalf of owners are not therefore covered by the Act. This includes services such as factoring, individual owner repairs and other management services provided to owners.
Any FOI request therefore made in relation to services to owners will not, therefore, be treated as a request under the Act.
As part of our commitment to openness and transparency, Levern Property Services has adopted a Guide to Information which sets out the range of information that we publish. Our Guide complies with legal requirements and is consistent with the Scottish Information Commissioner’s Model Publication Scheme.
Even though some services might not be covered by the scope of the Act, we will still aim to provide a wide range of information about the services we deliver through our website.

If we withhold information, we will let you know why. If you are unhappy with our decision, or with the way we have dealt with your request, you can ask us to review our decision.

As indicated above, services to owners are not covered under the Act – so such requests will not be accepted as legitimate FOI requests.
