About Freedom of Information (Levern Property Services)

The Freedom of Information (Scotland) Act 2002 (the Act) requires Housing Association’s and subsidiaries (from 11 November 2019) to adopt and maintain a Guide to Information which complies with the Scottish Information Commissioner’s Model Publication Scheme, and publish information in accordance with that scheme.

In addition to this duty to publish, organisations must respond to legitimate requests for information they receive, and help people who want to access information covered by the Act.

Alongside the Act, the Environmental Information (Scotland) Regulations 2004 (the EIRs) provide a separate right of access to the environmental information that we hold.

Scope of FOI – LPS

Levern Property Services is only subject to the Act to the extent that it carries out services, on behalf of Barrhead Housing Association, in relation to the management of social housing accommodation.

Services which LPS therefore carries out on behalf of owners are not therefore covered by the Act. This includes services such as factoring, individual owner repairs and other management services provided to owners.

Any FOI request therefore made in relation to services to owners will not, therefore, be treated as a request under the Act.

Our Approach

As part of our commitment to openness and transparency, Levern Property Services has adopted a Guide to Information which sets out the range of information that we publish. Our Guide complies with legal requirements and is consistent with the Scottish Information Commissioner’s Model Publication Scheme.

Even though some services might not be covered by the scope of the Act, we will still aim to provide a wide range of information about the services we deliver through our website.

Our Guide and Procedures

Our Guide can be accessed here and includes direct links to the range of documentation which we publish under this Guide.

A copy of our approved FOI policy is available here

Our FOI procedures and charging arrangements can be found here

Over and above this, a wide range of information can also be found across our website and that of our parent Barrhead Housing Association (www.barrheadha.org)

Further information in relation to FOI can be found on the Scottish Information Commissioners website at http://www.itspublicknowledge.info/home/ScottishInformationCommissioner.aspx

Withholding Information

Under the Freedom of Information legislation, information may be withheld if there is a good reason for doing so.

If we withhold information, we will let you know why. If you are unhappy with our decision, or with the way we have dealt with your request, you can ask us to review our decision.

Detail of Exemptions and other FOI briefings can be found here

If you do not agree with the outcome of the review, you can ask the Scottish Information Commissioner to investigate.

Our FOI communications with you will always provide full detail of our decisions, and your rights – both for an internal review and to make an appeal to the Scottish Information Commissioner

As indicated above, services to owners are not covered under the Act – so such requests will not be accepted as legitimate FOI requests.
